Short-term rental rules, town by town
As of September 2026, no town in Haywood County, and not the county itself, has an ordinance written for short-term rentals. Whether a house can be rented by the night is answered, where it’s answered at all, by each town’s ordinary zoning code, and the four codes say different things. This is what each one publishes, read from the code itself, and where the question is being worked on. It is a reading of public documents, not legal advice; the planning office for each town gives the answer for a specific address.
Waynesville. The Land Development Standards (the Town’s zoning code, consolidated September 2026) has no short-term rental use and no definition for one. Its definitions chapter lists bed-and-breakfast homes, boarding houses, inns, and hotels, and says a multifamily building whose units rent for less than a month counts as lodging. The Planning Board held public hearings on a short-term rental text amendment on April 15, 2024 and again on October 20, 2025; the second notice names sections 2.5, 3.3, 13.5, and 17.3. Nothing on the Town’s site says the Town Council has adopted it, and the code as posted doesn’t include it. Development Services is the office to ask.
Canton. Canton’s Code of Ordinances, published online through American Legal, has no short-term rental chapter, and the Town’s planning page lists zoning, floodplain, annexation, and addressing as what the Planning Department handles. Zoning questions go to the Planning Department at Town Hall.
Maggie Valley. The Unified Development Ordinance’s table of uses has no short-term rental line. Its lodging rows are bed-and-breakfast inns; hotels, motels, and inns; and RV parks and campgrounds. The first two are allowed in the mixed-use and commercial districts and in none of the residential ones; RV parks are a special use in R-4 and the Community Attraction district. The dimensional table does name an “R-4 Seasonal/Short Term Residential” district, but in the use table that district allows manufactured home parks and RV parks by special use and lists houses as not allowed, so it isn’t a district for renting houses. The Planning Department answers what applies at a given address.
Clyde. The Town’s zoning ordinance, linked from the Ordinances & Plans menu on its website, has no short-term rental section, and the Town code published through American Legal has none either. For a use the ordinance doesn’t name, the Zoning Administrator at Town Hall gives the answer.
Outside the towns. Haywood County has no zoning ordinance. Its code index (July 2026) runs from addressing to wireless towers and covers subdivisions, steep slopes, ridgetops, watersheds, floodplains, manufactured home parks, junkyards, high-impact development, noise, and solid waste, with nothing on rentals of any length. That leaves the county’s noise and nuisance rules as the ones that reach a rental house in the county; see report a problem short-term rental.
What state law lets a town do. North Carolina’s planning statute, G.S. 160D-1207, says no local government may require a rental owner to register the property or get a permit to rent it, except for an individual property with more than four verified violations in a rolling twelve months, two or more in a rolling thirty days, or one identified in the top ten percent of properties for crime or disorder under a local ordinance. It also bars special fees on rental property that other property doesn’t pay. Towns can still say in their zoning where lodging uses are and aren’t allowed.
Where it gets decided. A rental rule is a text amendment to a town’s zoning code. The town’s planning board reviews it first, and the elected board (the Town Council in Waynesville, the Board of Aldermen in Canton, Maggie Valley, and Clyde) holds a public hearing before it votes. Waynesville is the one town Haywood County's own Inspections Department excludes from its jurisdiction — inside Waynesville town limits/ETJ, the Town's own Building Inspections Department (number above) issues building permits and handles property-maintenance/junk-vehicle code enforcement instead of the county.

The Town's website footer lists 828-648-2376 as its "Emergency" number, which is the number Canton publishes for the Canton Police Department, alongside the Sheriff's Office dispatch line and 911; no separate Clyde police number is published, so after-hours calls go to the Sheriff's dispatch line (see the Sheriff's Office entry).

The county doesn't have a standalone "Code Enforcement" office — Development Services handles building inspections, permits, planning, and zoning/erosion-control enforcement (fax 828-452-6791). Separately, the county's public-nuisance ordinance — Chapter 159, Public Health and Solid Waste Awareness and Compliance — is enforced by Environmental Health working in conjunction with the Planning Department and the Sheriff's Office, and it applies only in the unincorporated areas of the county. It covers accumulation of trash, objects that hold water and breed mosquitoes, and rodent harborages; the county's stated goal is voluntary compliance, with court action only when that fails. Note that the county's Code Enforcement page itself lists only the agency-wide Health & Human Services front desk, which is the number carried under Haywood County Public Health: https://www.haywoodcountync.gov/456/Code-Enforcement. The county's Fire Marshal's Office is also organized under Development Services (site breadcrumb: Development Services > Building Inspections > Fire Marshal) — it handles burning-permit questions, whether burning is allowed on a given day, and burn bans; the actual permit itself is issued by the NC Forest Service's online system, not this office.
